Banking & finance update
Associate, Pat Nyhan, examined some recent key cases relating to default interest and guarantees which lenders and borrowers should know about– including Allied Irish Banks plc v McKeown and McCarthy. Pat also took a look back at the significant case of Harrington V Gulland from June 2016 which looked at the effect of non-registration of the change of ownership of a charge on its enforcement, and how it is still a potential issue for lenders. Company law update
Partner, Emer Moriarty Crowley, briefed attendees on the Companies (Accounting) Act 2017, proposed amendments to the Companies Act 2014, the recent government report on White Collar Crime, and what she expects to see coming down the track in 2018 from a company law perspective. Employment law update
Associate, Triona Cody, provided an update on some of the year’s most significant, high profile employment law cases relating to bullying and workplace investigations – including the Lyons case. She also addressed harassment and sexual harassment in the workplace and outlined how employers should deal appropriately with such allegations. Partner and head of IP & technology, Maureen Daly, dealt with one of the biggest topics of the moment – the General Data Protection Regulation. With the deadline of 25 May 2018 fast approaching, Maureen outlined the five key steps for organisations to take to prepare for compliance with this important legislation. View Maureen’s slides here.
Beneficial ownership register
Partner and head of corporate & commercial, Shaun O’Shea, looked at the regulations relating to beneficial ownership registration which came into operation on 15 November 2016, giving effect to part of the Fourth Anti-Money Laundering Directive (4MLD). Shaun clarified some of the key provisions of the regulations and also outlined the proposed timetable for implementing the remainder of 4MLD. View Shaun’s slides here.
